RESERVATION TERMS AND CONDITIONS

 

 

1. Availability, Bookings and Changes to Bookings

 

1.1 All bookings may be made by telephone and once confirmed by Lurganconary Farms will be subject to these terms and conditions. You may contact Lurganconary Farms directly by telephone at our contact details provided to arrange the booking. Alternatively, Lurganconary Farms will contact you by telephone to arrange the booking. Until Lurganconary Farms receives a non-refundable deposit (the “Deposit”) of 50% of the total cost of the holiday cottage rental fee (the “Fee”) and provides you with a booking reference, all bookings will be provisional and subject to availability .

1.2 If the holiday is due to start on a date within 30 days of the date of booking,
the total of the Fee is payable at the time of booking. Lurganconary Farms will send to you confirmation in writing following receipt ( and clearance in the case of payment by cheque) of the Fee and this confirmation will also act as a receipt.

1.3 No changes may be made to any part of the booking without Lurganconary Farm’s express prior written approval.

1.4Lurganconary Farms will endeavour to assist you in a change to your booking, however additional charges may apply.

1.5 Changes cannot be accepted by Lurganconary Farms within 30 days of the date on which your holiday begins. If a change results in a reduction in the length of the holiday it will be regarded as a cancellation and may be treated by Lurganconary Farms as such under condition 6 below.

2.Security Deposit

2.1A refundable security deposit of £100 in respect of damage to and/or loss of Property equipment or contents is payable at the latest on your arrival. This deposit will be forfeited if loss or damage to the Property is discovered on your departure or these terms and conditions have not been complied with. Lurganconary Farms reserves its rights to recover from you the cost of any repairs to the Property or replacement of its equipment or contents in excess of the amount of the stated security deposit (which amount has not been used for payment of your telephone bill as set out below).

2.2As referred to above, it should be noted that Lurganconary Farms shall automatically deduct from the Security Deposit the amount payable by you and your guests in relation to telephone use.  Further reference should be made to paragraph 13 below in this regard.

Whilst the security deposit is payable at the latest on your arrival, it is preferable that such amount is paid earlier at the same time as the total Fee or the balance of the Fee (as applicable) is paid.


3.Price and Payment

The rates above are based on rental of the entire Property. Part rental of the Property or rental on a per room basis within the Property is unavailable. The above prices are subject to change at the discretion of Lurganconary Farms. An additional night’s accommodation may be arranged with Lurganconary Farms, subject to availability, at a rate of £85 per night.

For the purposes of the standard prices above:

“High Season” means the period commencing on the third Saturday in  June and ending on the second Friday of September (inclusive); Easter week – meaning the week commencing on Easter Saturday; the Christmas/New Year period - meaning the 2 week period commencing on 23 December ; and

“Low Season”means all other times of the year excluding the High Season. 

3.1             Upon receipt (and clearance in the case of payment by cheque) of the Deposit, Lurganconary Farms will send to you in writing a booking reference. The issue of this booking reference will also act as a receipt in respect of payment of the Deposit by you. In addition to sending to you the booking reference, included in this correspondence will be a reminder of the date when the balance of the Fee will be payable by you  (no further reminders will be issued). Such balance of the Fee less the Deposit will become due 30 days before the date on which your holiday begins. Lurganconary Farms will send to you confirmation in writing following receipt ( and clearance in the case of payment by cheque) of the balance Fee and this confirmation will also act as a receipt. If the balance of the Fee is not received at least 30 days before the date on which your holiday begins, Lurganconary Farms reserves the right to
cancel your booking and retain the Deposit without further notice.

3.2 Lurganconary Farm’s prices include VAT where appropriate. If VAT rates
change Lurganconary Farms reserves the right to amend its prices accordingly.

4.Minimum Stay

 

4.1The minimum stay at Lurganconary Farms is 2 nights.

5.Damage to Property

 

5.1You agree to keep the Property and its contents in the same condition and repair as on your arrival at the Property and to pay to Lurganconary Farms upon written demand, any costs incurred in making good any loss or damage to the Property or its contents caused by your action or omission or that of any guest.

5.2You are expected to take all reasonable care and must ensure that the Property is left in a clean and tidy condition on your departure at the end of your holiday. Lurganconary Farms reserves the right to charge you for any additional cleaning if this is considered necessary

6.Cancellations and Refunds

    • You may cancel your booking at any time provided you do so in advance in writing to Lurganconary Farms. Provided written cancellation of your booking is received by Lurganconary Farms at least 30 days before the date on which your holiday begins, cancellation of your booking will incur the loss of the Deposit only. If cancellation of your booking is received by Lurganconary Farms less than 30 days in advance of the date on which your holiday begins, the Deposit will be forfeited and you will remain liable for the full balance of the Fee.

 

    • In the case of cancellation less than 30 days prior to the date on which your holiday begins, Lurganconary Farms will seek to re-let the Property for all or part of the booking period and, if successful, may refund the Fee paid by you, less the Deposit. Lurganconary Farms reserves the right to re-let at a discount or for a
      shorter period than that which was originally booked by you, in which case it may refund a proportion only of the Fee paid by you, less the Deposit (taking into account the shorter period of re-let or discount granted).

6.3 Lurganconary Farms does not operate any scheme of cancellation or
travel insurance and you must obtain your own insurance cover for
the holiday.

6.4 Lurganconary Farms reserves the right to cancel the booking at any time
in the event that the Property is not available for rental as a result of any of the following circumstances: non-payment of the balance of the Fee, essential repairs and/or maintainence or any other event beyond its reasonable control. In the event of cancellation under this condition for any reason other than non-payment of the balance of the Fee, Lurganconary Farms will refund to you the total Fee received by it for the booking; in the event of cancellation for non-payment of the balance of the Fee, Lurganconary Farms will be entitled to retain the Deposit and reserves to itself the right to any other remedies it might have.

7.Arrival and Departure

7.1The cottage rental period begins at 4pm on the first day of the booking period and ends at 12 noon on the day of the departure. Possession must be taken between 4 pm and 4.30 pm on the day of arrival and vacated by 12 noon on the date of departure. In your own interests, if you wish to arrive later please advise Lurganconary Farms in advance. If you intend to depart early please inform Lurganconary Farms on arrival.  If your stay extends beyond this period you shall be subject to a charge for the additional days.

7.2In the event of non-arrival, the Property may be let from midday the following day.

9.Liability

 

9.1The liability of Lurganconary Farms in connection with the booking and these terms and conditions is strictly limited to the total value of the Fee paid by you.

9.2Lurganconary Farms accepts no liability for any special, indirect or consequential loss or damage of any kind howsoever arising, even in the event that it was foreseeable.

9.3In so far as is permitted by statute, Lurganconary Farms shall not be liable for any accident, loss or damage to any of your belongings or property.

10.Complaints Procedure

10.1 If you have any cause for complaint during your holiday at the Property please notify Lurganconary Farms who will make all reasonable efforts to assist and resolve the issue. Lurganconary Farms will not normally make any refund or recompense in respect of a complaint. All complaints should be made known to Lurganconary Farms during the cottage rental period.

11.Maximum Occupancy and Right of Refusal

11.1The number of people staying in the Property must not exceed the maximum number stated in the booking and the use of tents or sleeping in motor vehicles adjacent to the Property is not permitted.

11.2Lurganconary Farms reserves the right to refuse any booking.

11.3Lurganconary Farms reserves the right to terminate your rental of the Property and to ask you and your guests to leave immediately if this is deemed necessary by Lurganconary Farms, as a result of your behavior or that of your guests or any other material breach by you of these reservation terms and conditions. Lurganconary Farms reserves the right to refuse to hand over accommodation to any person who in its reasonable opinion is not suitable to take charge of the Property.

12.Description of the Property

12.1Lurganconary Farms will endeavour to inform you of any events which may be taking place at its site near the Property during your holiday. Lurganconary Farms does not accept any liability for any works or activity of any sort occurring on its premises adjoining or neighbouring the Property.

 

13. Use of telephone

 

13.1A landline telephone is available for use by you and your guests at the Property. Payment for telephone use shall be automatically deducted by Lurganconary Farms from the Security Deposit.  A copy of the itemised telephone bill shall be forwarded to you by post following departure.  In the event that the Security Deposit paid is less than the cost of telephone use, Lurganconary Farms shall contact you directly to arrange for payment of the balance amount owing.

13.Miscellaneous

13.1You must not use the Property for any purpose other than that of a holiday.

13.2You must not use the Property for any activity or in such a way as to cause nuisance or annoyance to Lurganconary Farms, its visitors or its neighbours.

13.3    You and your guests must comply with any reasonable regulations relating to the Property or the site within which the Property is situated, which will be communicated to you on your arrival at the Property.

13.4 Pets are not permitted at the Property.

13.5The Property is non-smoking.

13.6You must allow anyone authorised by Lurganconary Farms to enter the Property during the holiday. Lurganconary Farms will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.
